Inviting the Other Party to Mediate

The court encourages parties to resolve disputes through mediation. Whether you are the "plaintiff" or the "defendant", when a dispute arises, contact us immediately. We will send a letter of invitation to the other party stating your intention to resolve the dispute through mediation. If refused, the refusing party will be at a significant disadvantage. When the court exercises its discretion in awarding costs, it will consider all relevant circumstances, including the possibility of issuing an adverse costs order against a party who did not participate in mediation without reasonable explanation. In other words, the party that refuses mediation and insists on litigation may not recover the full amount of court fees and legal fees even if it ultimately wins the case.

Mediator Referral

Upon receiving your instructions, the company can refer a mediator to the applicant on your behalf. Before making the referral, the company will check whether the mediator has any conflict of interest in the case and request a quotation. This service avoids any inconvenience or embarrassment for both you and the mediator.

Mediation Logistics Arrangements

We can assist mediators and all parties in arranging meeting dates and venues, exchanging documents, and collecting, safekeeping and refunding mediation service deposits (if any).
